This website www.hashmato.com (the “Site”) is provided by LevelFive Solutions Pte Ltd. Use of the Site is governed by the following terms and conditions.

Please read them now. By using the Site you indicate that you accept the Terms and Conditions and that you agree to abide by them. If you are not willing to accept these Terms and Conditions you may not use the Site.

 

Terms of Service

These Terms of Service outline the responsibilities of Hashmato as a service provider and your responsibilities as a customer. Please review them carefully. These Terms govern any use of the Service and are effective from the moment Hashmato grants you access to the Service.

The Hashmato platform and services may evolve over time based on user feedback and improvements. These Terms are not intended to address every possible question or issue that may arise from using Hashmato. We reserve the right to modify these Terms at any time, with changes taking effect once the updated Terms are posted on our website. We will make reasonable efforts to notify you of significant changes via email or through notifications on our website.

Since the Terms of Service may change periodically, it is your responsibility to ensure you have reviewed and understood the most up-to-date version available on our website. By registering for and using the Service, you confirm that you have read and understood these Terms, and that you have the authority to act on behalf of any individual or entity for whom you are using the Service. You are also deemed to accept these Terms on behalf of any such entity.

1. Definitions

To help you understand these Terms, we have provided definitions for some key terms below:

  • “Customer” refers to the individual or entity that has entered into an agreement with Hashmato. If the agreement was made by an individual on behalf of their employer, then the employer will be considered the Customer and bound by these Terms.
  • “Authorized User” means any person or entity authorized by the Customer to use the Hashmato Service on their behalf. This includes the Customer’s employees, personnel, support partners, and any third parties with whom the Customer shares their Hashmato account details (and for whose actions the Customer is responsible).
  • “We” or “Hashmato” refers to Hashmato Pte. Ltd. and its related companies.
  • “Hashmato Service” refers to Hashmato’s suite of products, including but not limited to inventory management, point-of-sale systems, kitchen management tools, QR ordering, E-ordering, and any other features or services provided by us. The use of the Hashmato Service is subject to allowances or limits specified in the agreed contract.
  • “You” means the Customer and, where applicable, any Authorized Users.

2. Account Information

You agree to provide accurate, current, and complete account information and to promptly update your details as necessary. We will use your provided information to contact you regarding important notices, such as changes to your account or contract. It’s your responsibility to ensure that all contact details for your Primary Admin and Authorized Users are up to date.

3. Use of Your Account

Hashmato grants you a limited, non-exclusive, non-transferable, revocable license to use the Hashmato Services (depending on your account type) for your business in accordance with these Terms.
You are responsible for any actions or changes made within your account, including any input, modifications, or data access by your Authorized Users. The designated account manager will serve as our primary contact and is considered authorized by you to make changes and receive notices on your behalf.

If:

  • You are an Authorized User using the Hashmato Service for a Customer, you must have the appropriate permissions from the Customer.
  • You are a Customer, you are responsible for authorizing the use of the Hashmato Service by any Authorized User and will indemnify Hashmato for any claims or losses resulting from actions by any Authorized User.

Hashmato has no responsibility to anyone other than the Customer, and these Terms benefit only the Customer and not any Authorized User(s).

4. Cancellation of Accounts

  • We reserve the right to cancel or suspend your account at any time with written notice. Termination will take effect immediately if:
    You have materially breached these Terms;
  •  Providing the Hashmato Service in your jurisdiction becomes unlawful or impractical;
  • You fail to comply with any limitations on your Hashmato plan.

You may terminate your account at any time by contacting Hashmato support. Upon cancellation, your account will be deactivated, and all rights under these Terms will end. It is your responsibility to back up any data you wish to retain before cancellation.

5. Hashmato Services Are Provided "As Is"

The Hashmato Services are provided on an “as is” basis. While we will try to address technical issues promptly, we do not guarantee that the Services will always meet your specific requirements, be uninterrupted, or error-free. We also make no representation regarding your ability to meet legal obligations while using the Service.

6. Our Liability is Limited

To the fullest extent allowed by law, Hashmato is not liable for any direct, indirect, incidental, or consequential damages, including but not limited to loss of profits, data, or goodwill, arising from the use or inability to use the Hashmato Services.

7. You Are Responsible for Your Use of the Hashmato Service & You Indemnify Us

You are responsible for all activity under your account and for securing your account credentials. You indemnify Hashmato from any liabilities or claims arising from your use of the Services or failure to comply with these Terms.

8. No Malicious or Illegal Use

You must not use the Hashmato Services unlawfully, infringe on intellectual property rights, transmit offensive content, or use the Services in a way that could harm Hashmato’s systems or other users. Unauthorized access, data harvesting, or using bots to access the Services is prohibited.

9. Reasonable Use Policy

If Hashmato determines that your usage negatively impacts the performance of the Service, we may impose limits on your account. We will give you notice before applying such limits.

10. Intellectual Property Rights

Hashmato is the sole owner of all intellectual property related to its products and services. You may not reverse engineer or otherwise tamper with Hashmato’s intellectual property. We grant you a limited, revocable license to use the Hashmato Services for your business purposes.

11. Data Protection

We maintain appropriate measures to protect your data. You are responsible for complying with data protection laws and obtaining necessary permissions from individuals whose data you share with Hashmato.

12. Third-Party Integration Partners

In using certain optional features, you may instruct Hashmato to transfer data to third-party partners. You are responsible for compliance with applicable laws regarding such data transfers and for maintaining separate agreements with third-party service providers.

13. Data Deletion

Upon account termination, your data will be deleted within 7 days unless legal obligations require longer retention. Data may remain in our system securely isolated until fully deleted.

14. Disputes

Any disputes related to these Terms will first be addressed through discussions between the parties. If unresolved, the dispute will proceed to mediation or binding arbitration in Singapore.

15. General

The Hashmato Services are intended for business use only. Consumer protection provisions do not apply. These Terms are governed by Singapore law, and disputes will be subject to the exclusive jurisdiction of Singapore courts.
